Terms of Service

These terms are an agreement between Astrizon Technology Solutions Private Limited, a company registered in India, with its registered office at A103 MJ Lifestyle Astro, Chikkanagamangala Road, Bengaluru 560099, Karnataka, India ("Astrizon", "we", "us") and the organisation that creates a Zolensa workspace or signs an order with us ("Customer", "you"). They apply to app.zolensa.com, the Zolensa participant app and related services (the "Service"). By creating a workspace, accepting an invitation as an owner, or using the Service, you agree to them on behalf of your organisation and confirm that you may do so.

1. The Service

Zolensa lets research agencies design studies, invite participants, collect videos, photos, voice notes and answers, review them with their team and clients, and export them. We may improve and change the Service over time; we will not remove a core function you rely on without reasonable notice.

We aim to keep the Service available at all times but do not guarantee it is uninterrupted. Planned maintenance is announced in the app where possible. Support is by email on working days.

2. Accounts and your team

  • You give accurate details and keep them up to date.
  • Owners decide who joins the workspace and which studies each person sees, and are responsible for what their team and clients do in it.
  • Keep passwords and two-factor devices safe, and tell us straight away if you think an account has been misused.
  • The Service is for businesses. It is not for personal or household use.

3. Free trial

A new workspace may start on a free trial with the limits shown at sign-up. When the trial ends, you can still view and export your data, but you cannot start new studies or invite participants until you choose a plan. We may end trials that are misused.

4. Plans, fees and payment

  • Plans are priced per month by the number of active participants, as shown on our pricing page or in your order. Prices exclude VAT and other taxes, which you pay where they apply.
  • Unless agreed otherwise, we invoice monthly in advance and invoices are due within 14 days.
  • If an invoice stays unpaid for 14 days after a reminder, we may restrict the workspace to viewing and exporting until it is paid.
  • We give at least 30 days' notice of price changes, which apply from your next billing period.
  • Fees already paid are not refunded, except where the law requires it or we end the agreement without cause.

5. Your data and your participants

Everything you and your participants put into the Service ("Customer Data") belongs to you. You give us the rights we need to host, process, convert, display and deliver it to provide the Service.

For participants' personal data you are the controller and we are your processor. Our Data Processing Agreement forms part of these terms. You are responsible for:

  • having a lawful basis, and informing participants clearly, including through the consent form you publish in the Service;
  • recruiting participants lawfully, paying any incentives you promise, and following the research codes that apply to you, such as the ICC/ESOMAR International Code;
  • not inviting children below the age at which they can consent under the law that applies, unless you have verifiable consent from a parent or guardian;
  • asking only for the personal data your research needs, and avoiding sensitive data unless you have a lawful basis for it;
  • the retention period you set, and acting on participants' requests.

6. Acceptable use

You will not, and will not let others:

  • record or collect data from anyone without their informed consent, or use the Service for surveillance;
  • upload unlawful, harmful or infringing material, or content that sexualises minors;
  • use the Service to send spam, or for purposes other than research and related communication;
  • try to break, probe or overload the Service, get around its security or limits, or access other customers' data;
  • copy, resell or reverse-engineer the Service, or use it to build a competing product.

We may remove content or suspend access that breaks these rules, telling you why unless the law or safety prevents it.

7. Providers you connect

You may connect your own email, AI or other providers. Their terms govern your use of them, you are responsible for the keys you give us, and data you send through them is processed by them under your agreement with them.

8. Our intellectual property

The Service, its software, design and documentation belong to Astrizon and its licensors. We give you a non-exclusive, non-transferable right to use the Service during your subscription for your organisation's research. If you send us ideas or feedback, we may use them without obligation to you.

9. Confidentiality

Each of us keeps the other's non-public information confidential, uses it only for this agreement, and protects it with at least reasonable care. This does not cover information that is public, already known, independently developed, or that the law requires to be disclosed.

10. Ending the agreement

  • You may stop using the Service at any time; tell us in writing to close your workspace. Paid periods are not refunded.
  • We may end the agreement with 30 days' notice, or straight away if you materially break these terms and do not fix it within 14 days of notice, or immediately for serious misuse.
  • After the agreement ends you have 30 days to export your data, after which we delete the workspace and all Customer Data, including files, apart from what the law requires us to keep.

11. Warranties

We will provide the Service with reasonable skill and care. Otherwise, and as far as the law allows, the Service is provided "as is", without warranties of fitness for a particular purpose or that it will be error-free. You are responsible for your research design, your conclusions and how you use the results.

12. Liability

Neither of us is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data that could have been avoided by exporting it. Each party's total liability under this agreement in any 12 months is limited to the fees you paid us in those 12 months (or 100 euros during a free trial). These limits do not apply to your payment obligations, to breaches of the acceptable use rules, or to liability that cannot be limited by law, such as for fraud.

13. Indemnities

You will defend us against claims by third parties, including participants, arising from Customer Data or your research, except to the extent caused by our breach of the Data Processing Agreement. We will defend you against claims that the Service, as we provide it, infringes their intellectual property rights.

14. Changes to these terms

We may update these terms. For material changes we give at least 30 days' notice by email or in the app; the new terms apply from your next billing period. If you do not agree, you may end the agreement before they apply.

15. Law and disputes

These terms are governed by the laws of India. The courts in Bengaluru, Karnataka have exclusive jurisdiction, except that either of us may seek urgent relief in any competent court. Before going to court, we will each try in good faith to resolve the dispute within 30 days of written notice.
